Legal Question in Insurance Law in Illinois

Auto Collision Injured Passenger (Driver's wife) at fault

Hi.

I was in a car accident two weeks ago. I was running yellow light and i sudenly hit a car. I was unconsious so i and my wife both have to go to EMERGENCY care right away. Cops came and placed me at fault.

My wife was riding with me on front passenger seat. She got injured because of that incident and she was at the hospital for surgery whole last week.

I am just wondering can i sue my own INSURANCE company to claim her as an passenger injury coverage. According to doctor she won't be able to work until 6 months and she broke her two fingers, which will have some diffect for some time.

May i have some advice on this. Thank you very much!

I appreciate your help.

Your question does not state whether you have "medical payment" coverage on your automobile insurance policy. If so, you should certainly make a claim under that provision. If you are not represented by legal counsel, you may call me for a free telephone consultation at 314-727-2822.

Yes,you can make a claim against your own auto insurance company for your wife's injuries. If you purchase medical payments coverage and uninsured motorist coverage, you will be able to recover for medical expenses, wage loss, disability and pain and suffering. Please feel free to contact me regarding your rights. Scott Blumenshine 312-263-1000
