dui accident to my family wondering about his insurance for compensation amount

my husband and daughter were hit head on by a drunk driver who had a prior dui. he had insurance. we are wondering what to expect from his insurance company regarding payment. both of them have neck back currently seeing doctors. we just wanted to know a ball park figure when we settle with the insurance company so that we dont get taken adavantage of . is there anyway to estimate an appropriate amount? thanks

It is impossible to give you a "ball Park" figure as to the value of your claim based on the information provided. Remember that claims adjusters evaluate claims based on what would most likely occur at trial. Several factors go in to the evaluation of a claim by the insurance company:

The venue of any lawsuit, what type of witnesses the claimants will make, extent of injury and wage loss, and prior medical history. Extent of the fault of the claimant is also considered, but I don't think that will be a factor for you, on the facts provided. The last factor is the quality/reputation of your trial attorney.

Studies have shown that insurance companies pay more on claims with attorneys involved- so much so that most companies encourage their adjusters to talk to claimants before they hire attorneys!
