Legal Question in Insurance Law in Illinois
I hired a contractor to redo my outdoor balcony in June. In August, my electricity went out and ComEd came out for the repair. They claimed that the contractor had damaged the underground cable wire, which caused the power outage. They proceeded with the repair.
I received a bill from ComEd for nearly $12,000.00 for their repair services. My home insurance agent told me that they do not cover any damages outside of the house. I did not have a formal contract with my contractor, however, I do have a signed receipt to prove that he had worked on my balcony. I had contacted my contractor in regards to this situation, but he had said he does not have insurance to cover this bill either. I trusted him only because he had worked on my neighbors balconies, at least 5 other houses, without any issues. So, does this mean I am responsible to cover the entire $12,000.00?
I was never made aware that I would be responsible for the charges associated with the repair, nor was I ever given an estimate prior to the repair. I feel it is unjust that I should be responsible for such an exorbitant amount. I am a retired senior and feel it is impossible for me to pay such a large sum. I am seeking advice on what my rights are and how to best dispute this charge.

you need to contact a reputable lawyer in your community. most initial appointments are free. at that appointment make sure you bring your homeowner's insurance policy, the bill and any paper work from com ed and the contractor. just because your insurance carrier says there isn't coverage doesn't necessarily make it true. similarly with com ed - just because they say... doesn't make it true. your lawyer may need to litigate the matter by having the contractor, com ed and the insurance carrier as parties in the case. good luck but eventually you may not be held responsible for the bill. it will probably end up costing you money for the lawyer and costs but it might be well worth it. good luck.
