motion for new trial
I, plaintiff, filed my car accident case to small claim court after 5 months negotiation with defendent's insurance since I can not accept their low offer. Defendent attorney filed jury demand. I won Mandatary arbitration on Mar 14 2006 and Jury trial on Nov 13 2007. Now defendent attorney filed motion to ask for new trial and motion spindled hearing court date will be Jan 2008. my question is
the motion opposition must be filed within 14 days from Dec 13 2007 or I can ask motion hearing judge for 30 days from Jan 7 2008?
what and how can I do, judge might deny motion?
if motion was denied by judge on jan 7 2008, will defendent attorney file the appreal of the judgement? then what should I do? what will be new procedure. how can end this case as soon as possible?

The only way to end the case as soon as possible is to settle it.
An appeal can take several years. The Insurance company lawyers are not on the clock, so the insurance company can take as long as it wants.
