Legal Question in Insurance Law in Illinois

Receiving fair compensation after being hit by a drunk driver

One month ago I was in an accident where a drunk driver ran a stop sign and hit my car pretty hard. My car was totaled and I received minor injuries. I am now begining to get frustrated with the other driver's insurance company (Allstate) draging their feet. They do not return phone calls and have not offered any assistance. All they are saying is that their driver has hired a lawyer for her DUI. My vehicle is a vital part of my job and so far I have had to rent a car on my own expense. I am concerned that they will give me minimal compensation that will not be able to fairly replace my vehicle as well as cover all other expenses.

At this point I have only sought advice from an attorney friend of mine, but have not hired any attorney to handle this. I do not want to sue, but I also do not want to be taken advantage of. Any advice on what the most effective next steps I can take are? At what point do you recommend hiring an attorney?

Re: Receiving fair compensation after being hit by a drunk driver

The hiring of an attorney is a personal decision, based on a number of factors. The bottom line is: if your rights are not being protected on your own, a well-qualified attorney acts as your advocate.

You should not have to bear the negative financial and -- as you say, personal injury -- consequences without just compensation.
