Legal Question in Insurance Law in Illinois
tort defendant what should i do ?
over 2 years ago, then i was working for a trucking company as a driver, i got into car accident car. i didn't think the accident happened because of my fault (i've got a ticket though), wanted to go to court , but didn't go because of the family emergency, so i paid the fine. i gave all the papers concerning the accident to my boss, being sure that truck i've operated was covered by insurance (that's what my boss told me - truck is covered) and insurance company is going to take care of everything. in a month i quit working for that company. 2 years have passed. during this time i've never heard anything from anybody about this accident. in the middle of august 2002 i've got tort papers - plaintiff's insurance company is suing me for damages, because they never got the money from insurance of the company i've worked for . i found out that ''my'' truck company is inactive/dissolved. i believe that my boss just did't have insurance for the truck i was operating. should i sue him now? what should i do?

In the first place, you should hire an attorney to represent you in the pending lawsuit. That attorney will also look into possible avenues of relief against your former employer. Good luck.
