Legal Question in Investment Law in Illinois
Identity Theft
Someone has been illegally accessing my Fidelity IRA brokerage account since early October. I just discovered this recently when I tried to log in to my account for the first time since late September. When I had last logged into my account, I had most of my money in cash and had a total account value of $130000. I tried to open my account today but found that someone had changed the password multiple times. The account now has a value of $8000 after someone made several unauthorized trades. Fidelity has a customer protection guarantee but I am not sure if they will compensate me for this criminal activity. I believe the perpetrator may have hacked into my computer to obtain my username and password and it seems like he might have been using my computer to remotely access the accounts so that he cannot be tracked. Fidelity had never bothered to notify me that my password had been changed so many times. I had not received any emails or paper mail to notify me of any of this activity. What legal options do I have if Fidelity decides to not reimburse me?
