if an agency has progressive displine as part of it's policy and suspend or fire you with out doing so. can you challenge them and win

Possibly. It depends on quite a few factors. There is usually some sort of provision which would allow them to fire someone without notice. In any event, to give you an answer, your employment documents, policies, etc., would need to be reviewed.
