Legal Question in Employment Law in Illinois
Right to Certificates Earned During Employment?
I attended a mandatory, company-paid job-related training course. Following the course, certification exams were taken. I was terminated from the company shortly after. I am trying to find out the results of those exams because I would like to use the certifications on my resume. Unfortunately, my former employer will not respond to emailed requests, even though they said they would. I was notified prior to my dismisal by the test giver (by email) that I had past one of the exams. However, the certificate would be sent to the company.
Do I have any legal right to a copy of the certificates?

Re: Right to Certificates Earned During Employment?
You have a right to a copy of everything in your employment file under 820 ILCS 40, the Personnel Record Review Act. They must provide access at reasonable times and copies, which they may charge a reasonable fee. Send a certified letter to the human resources department requesting examination of your file and copies of certain items. Also contact the test administrator for duplicate copies.
