Commission Agreement with out of State Employer

I would like to know which state has jurisdiction if

one has a full time home office in Illinois

employed by a Minnesota Company as an

employee and there is a dispute regarding

commission agreements. That is, where would a

suit be filed against the company for unpaid

commissions while employed?

There may be more than one state that could exercise jurisdiction. The first place to look in order to answer your question is determine whether there is an employment agreement designating the jurisdiction in the event that a suit arises.

In the absence of that clear mandate, courts typically look to a number of factors and statutes in order to determine whether it has jurisdication over the matter & defendant(s).
