Legal Question in Employment Law in Illinois
We are trying to decide the best and legal language to use when a person walks into our business and asks if we are hiring. Are we allowed to tell them no and send them on their way? Or, are we required to distribute an application even if we have no open positions? We do not wish to cross the Antidiscrimination laws. Thank you for your time.

If you're not hiring you're not hiring. Period. But most employers say they're not hiring but if the person would like to fill out an application it may be kept on file for a while. Some people will be thankful; others will not bother. But there's no obligation to hire just because someone fills out an application, either.
