Legal Question in Employment Law in Illinois
Can a dishwasher who also serves as a busboy be allowed in a tip pool if he spends more than 80% of his time in the back of the house doing dishes, cleaning, unloading trucks etc...? We are forced to tip out 3% of our sales to him everyday no matter that we servers bus our own tables 80 to 90% of the time.

House rules about tip-sharing, if consistently applied, are perfectly ok. If you feel the rule is unfair, you need to talk to your employer.
