If you believe you were wrongfully terminated from a job in Illinois, do you have to start with the EEOC or can you just get a lawyer?

It depends on the nature of the termination. If, say, you had an employment contract for one year and, in breach of the contract, your employer terminated you, you would not go to the EEOC; rather, you could initiate a lawsuit immediately.

If, on the other hand, you were terminated on the basis of wrongful discrimination, then you must first file a claim w/the EEOC or the Illinois Human Rights Commission, depending on the circumstances. You file suit only after you get a "right to sue" letter from the EEOC.

If you have a case that an attorney thinks is strong enough, it is a good idea to have an attorney make the filing w/the EEOC and/or Human Rights Commission.
