What legal recorse does an employee have if it is discovered that the employeer has not been paying in insurance premiums which are being deducted from paychecks.

I assume you are talking about medical insurance and not disability insurance or workman's comp. coverage, correct? An employer could face significant problems from the state of Illinois for failing to maintain coverage of his employees, especially if there are dedcutions being made for premium costs.
Either way, it is an extremely serious matter and you should pursue legal assistance. You should also discuss the matter with your [health] insurer as you do not want to be left without coverage.
