Employment rights

I was laid off of my current full time job last week, being told the budget was being cut. Without being told anything else, they proceeded to interview for a part time employee. I feel I was let go because of a personality conflict with my boss which consisted of almost daily harrassment of some form. Should I not have been offered that part time position? I feel the reason for letting me go was NOT the budget. Do I have a fight on my hands.

If you are an "employee-at-will," meaning one who does not have a contract that specifies the length of employment and the terms of termination, then an employer can fire you for "any reason or no reason at all." The only exceptions to this rule fall within certain statutory protections, such as unlawful discrimination or "whistleblower statutes," such as reporting a violation of law. Among the wrongful discrimination factors are race, religion, sex, age, etc.

If you are, in fact, an employee-at-will and the form of "harassment," as you term it, is not based on one of the protected areas of discrimination, then you have no claim.
