If you are fired from a job for assault of co-worker and a police report was taken but no legal action taken, do I need to state this on a job application for a new job?

Depends on what the job application asks for. For example, if it asks if you were ever "convicted", then a truthful answer appears to be "no". If it asks about previous jobs and why you left them, there are various levels of "truth". You might answer with some of the facts, but then you might not be hired. You could simply say you were fired, which is truthful, but then someone during the hiring process may ask "why", and then you'd have to explain. So if you tell the truth you might not be hired, but if you lie and at any time in the future the situation is brought to their attention, you could be fired for not telling the truth.
