Legal Question in Employment Law in Illinois

forced to go fulltime

45 Year old female working parttime 3 days a week x 8 hours a day, for the past 5 years. Has received very high annual performance reviews. Management recently stated she must go fulltime 5 days (40 hours), if she does not agree to going fulltime, they will consider it a self termination. Can they legally do this?

Re: forced to go fulltime

Hello. In my opinion this is an unfair work practice. You may have a case. You definitely

need representation. In many instances, the suc-

cess of a lawsuit, in your particular situation,

will depend upon the history of your relationship

with your employer and what could reasonably be

expected of you. Your explanation of the facts

leads me to believe that you may also have a claim for retaliation. I will be happy to answer

any additional questions that you might have.
