Legal Question in Employment Law in Illinois
My husband has been off work due to a work related injury for almost a year. We have been trying to cash out & close his 401K plan which was voluntary & he is 100% vested. Mass Mutual & ADP refuse to allow us to do this stating they can only cash out if he is terminated. There is no requirements like this in his handbook. Can they do this when it's voluntary & our money?

You need to look at more than the handbook. You have to look at the actual plan, not just what is provided to the employee.
