Libel in a Performance Appriasal

Would I have recourse if my supervisor made statements in a perfomance review that are unsupported, undocumented and untrue? Pay raises and promotions were denied due to the untrue statements like ''unethical behavior'', ''excessive absentieeism'', ''reduces office morale''.

A recent review of my personnel records indicate no evidence to support these statements.

It often depends on the circumstances surrounding the whole thing. You may go through your personnel department to attempt to correct the errors, etc. You should consult with an attorney.

Whether or not you have a claim probably depends on whether or not the untrue statements are the result of unlawful motivation (ie. - bias against you because of race, sex, taking of protected FMLA leave, etc.) Please feel free to contact me at 317-955-9500 if you have further questions.
