Non compete agreement

I worked as an independant,

captured agent for an insurance

company. I was not an employee.

The company insists that a non

compete agreement was part of the

contract signed to work as their

agent. The company terminated my

agreement in March of 2007. In

October I decided to come back to

Illinois and work as an independant

agent. Is a non compete enforceable

in this situation. All of my research

deals with non competes between

employers and employees.

A no-compete between an employer and an employee is a contractual (sometimes enforceable -sometimes not) agreement: a no-compete between independent entities (you and the ins.co.) may be an enforceable contract as well. In fact it is more likely to be enforceable -� BUT in any case ALL no-competes need to be reviewed for the specific language contained therein and the relation of that language to the facts of the relationship between the enitities and the marketplace. You need to have the co-compete looked at by an employment lawyer. You may have to litigate.
