non-compete agreement

Dear Sir,

this is the question:

I signed a non-compete agreement which says this in one of the paragraphs:

Employee agrees that during the term of his/her

employment and for a period of 12 months from the date

of his/her termination of employment he/she will not

engage, directly or indirectly, alone or as a partner

of a partnership or other entity, or as an consultant,

employee,

1. in providing any of the services to any customer

of(the name of the company) at whose locations or on

behalf of which employee provided services in his/her

capacity as an employee of (the name of the company)

2. in soliciting or attempting to sell products or

services similar to those sold by (the name of the

company) to any customers or prospects of (the name of

the company)with wich the employee had contact as an

employee of (the name of the company).

Now I am working as a consultant of my company

(Company A) to a diferent one (company B). Company B

signed a contract with Company A where they said that

Company B will be able to hire me after 3 months with

the payment of a fee or after 6 months with no

payment.My question is, if I'll accept the offer of company B after 3 or 6 months can my Company A still sue

me?

That is a very good question. You need to take several steps before you accept Company B's offer. A majority of what you have to protect against depends on the contract between Company A and Company B. Hopefully, the contract between A and B addresses your non-compete agreement.
