Legal Question in Employment Law in Illinois

Overtime laws

I have an unknown number of overtime hours for the past three years that I was unaware of that this was a law and not just an employers decision. The office typed up a figure of 387 1/2 hrs unpaid at 1/2 time (I was paid at straight time for these hours). I am not sure of this correct total as I do not have any records/paystubs, so I have to trust in their figure. Can records from the payroll service (Advantage)be ordered? What penalties does he face? He would like to settle out of court and out of the labor board (there is a claim currently with the wage and overtime labor board)and I would like that also, but I want what is owed plus some. I have been a loyal and responsible empolyee for three years and he surely took advantage of me. Please help with any other issues related to my claim-Thank you, Claudia

Re: Overtime laws

Sounds like you very well have a claim and, indeed, this could possibly be a class action. Feel free to contact me, if you wish.
