Although one is hesitant to give definitive answers in this forum without knowing all of the facts of a particular situation, I do not know on what basis you think you would be entitled to keep money that you did not earn and to which you admit you are not otherwise entitled. From a "gut" perspective without the benefit of research into the labor law, it would seem that the answer to your question is, "yes."
