Pre-employment drug and physical screening
My husband was offered a sales job contigent on passing drug and physical screening. He's a diabetic so his test showed sugar in his urine. He was asked to submit a letter from his doctor stating he is being treated for diabetes. He did that and then he was asked to get a blood screening for his hemglobin levels which came back high -normal range is 5-7 and his was 10. It's been 2 weeks and he can't get his ''new boss'' to call him back. Was is legal for them to ask for this blood test and can this be considered discrimination against him now that they know he's a diabetic and do we have any grounds for suing them - they are a major company throughout the united states.

Hello. There was an article this week that discussed this issue. It is my understanding that it is now illegal in Illinois to deny a person a job based upon their potential illnesses. This apparently just was passed by the Illinois legislators. Your husband may have a basis for a lawsuit. Will be happy to discuss this further and in more detail.
