Legal Question in Employment Law in Illinois
Pregnancy discrimination
I was fired when I was 8 1/2 months
pregnant, I was told it was because
the company was financially doing
bad, yet I was the only person let--
name removed--
it made no sense to me because 2
weeks prior I was asked by the
president to consider a higher
position upon returning from
maternity leave, which would include
travel. Do I have reason to file a
claim against the company for
pregnancy discrimination?

Re: Pregnancy discrimination
Your case may have merit. But you will have to have some evidence to counter the simple fact that employers can fire people. If they can argue it was because of poor work, you have to show you had a good work ethic.
Re: Pregnancy discrimination
Hello. Your firing does sound suspicious, however a more thorough investigation will be needed to determine whether you will have sufficient evidence to establish a claim of discrimination. It will be necessary to prove based upon a preponderance of the evidence that you were treated differently from others similarly situated who were not pregnant at the time you were fired. I will be happy to answer any additional questions that you may have on this subject.
Re: Pregnancy discrimination
You may very well have a case for pregnancy discrimination against your former employer. If successful, you may be entitled to backpay, compensatory and punitive damages. We obtained the second highest verdict in a pregnancy and FMLA case in Chicago in Sept 2006 - Buffone v. Rosebud Restaurants. The case is featured on our website. Kindly provide me with your contact information upon receipt of this message via [email protected] so that we can discuss in greater detail. I look forward to hearing from you.
