Legal Question in Employment Law in Illinois
being replaced due to hurt on job
I was hurt on job and needed surgery, after returning from 3 months being off recouperating I returned to work. due to not being able to walk without crutches I had to do a sit down job, answering phones. My original position required being on my feet all the time as a medical asst. but I was told I was being replaced to cover for another girl on phones temporarly till she came back in 3 months. I recieved no notice or anything to sign to agree with them. is this legal? and now they just told me my pay would be demoted. how is this possible? I get hurt at wk, have surgery, return with crutches and boot on foot. and I get replaced and less pay, oh yes, I work 5 hrs a day per Dr. request and I was told I don't get a lunch or break. if I want a break I need to punch in and out. well no one else does, so why should I have to? this is not fair. any advice?

Re: being replaced due to hurt on job
You may very well have a worker's compensation claim and a claim under the FMLA. Please provide me with your contact info to [email protected] so that we can discuss this in greater detail. I look forward to hearing from you.
