Revocation of severance benefits

A few months ago I was informed by Human Resources, my direct supervisor, and his direct supervisor that my position along with others in my division were being eliminated and I would be eligible for severance benefits. Termination date was not specific but was indicated it would probably be the 1st quarter. I was given information on the severance package and unemployment benefits. 3 1/2 months later I was told and others in the division being eliminated were told that we would be assigned to new positions and would not be eligible for severance if we did not accept the new position. Is that legal?

Often a company will attempt to place a person in another similar position before laying people off. They have some rights regarding this procedure. However, it all depends on the exact circumstances of your case. Was there any written agreement, is the job being offered similar to/same wage level, etc. There are many issues to consider. I would advise you to contact any attorney to ensure you receive the correct advice.
