Legal Question in Employment Law in Illinois

I have a simple IRA where I work and my employer takes a percentage out my check each and then matches it. He is currently almost 5 months behind on sending the money in to be put in my account. What can I do?

If he doesn't have the money he doesn't have the money, and if he can terminate the benefit he should rather than leave you hanging. If he hasn't terminated the benefit then you can at least talk to him about it. But in the end if he doesn't pay all you have is a legal claim for the money, and it may be time to stand in line. And if he does have the money but is spending it on other things, like keeping the doors open so you have a job, consider the situation carefully.
