Legal Question in Employment Law in Illinois

I was terminated at my job due to lack of work. I worked at a car dealership, as an internet sales manager. I am currently fighting a DUI case in Illinois, which again is why I was terminated. I filed for unemployment and received it. But I am now having to go through a hearing because my former employer claims I quit. I am wondering is the worth looking into legally because even though my employer was wrong will I be able to recieve unemployment?

You have the absolute right to defend yourself against a claim that you quit as opposed to your being severed for lack of work. The problem is proving it. If others were laid off around the time you were, that might be some proof, as would the company's own records of your severance. Whether they might falsify them in their favor is something you can't predict. But you say you were terminated for a DUI as well. That's different. If having a clean driving record is a condition of employment, however, then without more information that could be a problem.
