Legal Question in Employment Law in Illinois

My wife had been employed by a company, she left in July 2008, which had a IRA funded both by the employee and employer. She received a statement in Jan of this year along with an election form rolling the account over to an approved IRA account. The owner of the company has not done so, the plan administrator has not followed through either. What action can be taken?

Check with the company and plan administrator? Maybe something got lost in transmission? Replace the form? Was she even vested in anything other than her own contributions?
