Legal Question in Employment Law in Illinois
I worked as an independent contractor for a company from March to November 2012, and the month of April this year. They have not paid me for the last pay period, which was four days, at $60/day. I have called and left polite voicemail messages requesting my final check, the only response has been for them to send me 1099 forms for 2012, which I was not expecting. Luckily I had filed for an extension, because the tax forms arrived at my home on May 13. I know from speaking to other contractors that they have never received tax forms in the past, leading me to believe that the forms were sent to me out of spite (the woman in charge of pay has bragged about vengeful deeds in the past, such as posting fake ads with dissatisfied customers' phone numbers on craigslist). I have remained cool in my messages (odd that they don't ever pick up the phone, as they are still in business; must be screening calls), and since they won't speak to me I believe they are trying to avoid paying me altogether. Another contractor I worked closely with reported that he was paid. Other than suing them for wages owed, is there any recourse? Thank you very much, and my apologies for rambling a bit..
1 Answer from Attorneys
Get an attorney to write a letter to them. If they continue to willfully withhold the amounts, it's possible to sue them for $240 plus the cost of an attorney to file and prosecute the suit (and even fees for willfully withholding the amount).
