Wrongly 1099'ed

My former employer told me that I was getting taxes taken out of my paychecks. Well in feb. I get a letter in the mail from my employer. I open it up and it is a 1099 tax form. I go into work the next day raising hell and get fired for saying I will not pay 1099 taxes when I was an employee.

I was defiantly an employee. Had a manager tell us when to come in, used all the company equipment, etc. My question is, can I take legal action against this scum bag company? Also there is tons of OSHA violations that this company commits, along with no health or vehicle insurance.
