Legal Question in Employment Law in Illinois
Last year, I was denied Workmens Compensation by my employers Insurance Carrier. His determination was based upon his investigation but recently I was awarded a settlement due to negligence. Can I sue my employer for bias?

It may be possible to have both a negligence claim and a workers' compensation claim. In other words, you may also be entitled to an award through the Division of Workers' Compensation. Whether or not this is the case is highly dependent on the facts of how the accident occurred, where it occured, whose fault it was, etc... In order to determine whether you have an additional claim, more detail would be needed. You may still be able to go after workers' compensation benefits, despite the fact that you were initially denied. However, there are time deadlines for pursuing the claim, and I cetainly would not delay.
