Legal Question in Landlord & Tenant Law in Illinois
I went to court about two months ago and at that time the judge granted me $1154.00 from a $1300.00 security deposit that was owed to me. She took out carpet cleaning and painting, trying to be fair I guess becuase that was wear and tear on a unit. The judgement was to be paid on 2/1/2010 and on 2/15/2010 I received a call from the landlord's husband saying that he wanted to make a deal and just give me $800 becuase the judgement doesn't mean anything and their lawyer says I need to take that or nothing at all. This has prolonged for almost a year now and I am tired of going back and forth with them, what else can I do?
1 Answer from Attorneys
In general, a person who has won a judgment in court against another person has the right to return to that court to enforce the judgment by means of a lien on the real estate, a seizure of bank accounts or investments, or garnishment of wages or other assets. This would cost money to go to court, and to discover what assets the person has. Are you willing to pay an attorney and court costs? If not, then settle.
