Legal Question in Landlord & Tenant Law in Illinois

deposit refund

Hello. My name is--name removed-- I was renting a house for 1400/mo. I recently moved out. I did not ask to be let out of my lease of one year. My landlord called me and asked if I wanted out of my lease he would not hold me to it because he thought I would not be able to pay 1400 dollars a month plus utilities which he stated would run 500 a month so he let me out of my lease. I was in the house for 6 months. I just moved out Nov1. He am I entitled to a full refund of my deposit of $1400? Also I did not clean carpet he states that carpet was so dirty that it could not be cleaned so he has to replace it in the family room and one bedroom. There were beverge spills in the and dirt in carpet all it needed was to deep clean the carpet. So now he says he has to replace the carpet and garbage disposal in kitchen sink due to glass. My question to you is can he take me to court for this and since he has my $1400 deposit can that go towards repairs?

Re: deposit refund

You are entitled to whatever balance of your security deposit is left after reasonable upkeep by the landlord. Generally speaking he will not take you to court, he will judge make repairs out of the $1400 he already has. You, on the other hand, can take him to Court if you want to dispute some of the charges he is making (for example, the new carpet).
