Eviction

I went to court for an eviction and asked for a jury hearing they gave me a date to return 1 week later. I wanted to know if there is anything else I can do to stall another 2 or 3 weeks. Will I be having the hearing on that same day?

Hello and season's greetings. It is

unlikely that you will have a jury

trial in a week. You or the landlord

may want to conduct what is called

discovery. Discovery is a legal term

which describes the method that either

side may use to get information to win

the case. Also, there is a good pos-

sibility that the landlord may asks

the court to order you to pay rent

while this jury trial is being scheduled. This is called a "use and

occupancy" assessment. I suggests you

get a lawyer. A jury trial is quite

a task and each side will have to

submit "jury instructions" to the

judge, usually just before the closing

arguments of plaintiff and defendant.

Also be mindful of the fact that during the jury trial there are objections that will need to be made

to evidence, etc. I will be happy to

discuss this with you further. As to

an additional extension of time, you

probably will be able to get the trial

extended, but getting a lawyer to

guide you through this process is

adviseable.
