Legal Question in Landlord & Tenant Law in Illinois
My husband passed away in Jan. 2012, we were behind in our rent when he passed .Iv'v been paying towards the back rent but am still getting further behind in current rent.The land lord wants to have there attorney draw up a legal paper saying that when i get a settlement from work mans comp,that they will get there money.If i sign this does it mean that they have to do the repairs on the house that haven't been done before we got behind and since my husband has passed . I'm mean like the electrical out lets that quit working central air needs replaced it makes electric bill in summer very very high the bed rooms both need carpet replaced ther is going to be a leak in ceiling in dinning room. What do i do?

Sounds like your landlord is willing to work with you, but Illinois law also requires landlords to make needed repairs if they are part of the landlord's obligations under the lease or tenancy agreement, but you must give proper notice. The point is that there are some offsets to rent if the repairs are not made. You really need to get an attorney involved if at all possible to negotiate a mutually workable arrangement with your landlord.
