Legal Question in Landlord & Tenant Law in Illinois
Can a landlord use a five day notice (for eviction) if it is four months old? We received a summons for court from our landlord because he has started the eviction process claiming we owe him money when we do not. I consulted a lawyer about this who told me to asked for the case to be dismissed on the grounds that the landlord did not give us a five day notice first, even though he stated that he did. The landlords wife told my husband today that he was planning to use one that he supposedly taped to our front door four months ago (which again, we never received and I was told he has to physically hand it to someone). Since this supposed time he has continued to collect money from us with no problem until now. Can he use this supposed five day notice from four months ago?
