Legal Question in Landlord & Tenant Law in Illinois
My landlord died with no will. Three persons have appeared to collect rent. How do we know who to pay?
1 Answer from Attorneys
The one with proof of the right to collect rent. Usually the administrator of an intestate (no will) estate. Sounds like they may not know what they're doing and you don't want to risk a landlord's notice (even if it then identifies the party entitled to rent), so you may want to ask who is representing the estate and if there's an attorney for the estate, so you can make your rent payment. When you offer money things happen..... While it might cost a few $ too, one way would be for you to have an attorney contact these people and try to get things straight. What you would want to do is help them make sure rent is continued, and that you would want to make your check payable to the "Estate of XXX, Deceased" as your protection.
