Had a judgement for possession against tennant but reinstated lease (in writing) b/c tennant wanted to stay so he paid in full plus court fees. He has a new baby and seemed to be sincere about getting on track. Now, once again tennant is behind in rent payment(all of May and now June is due); do I re-open the old case, start a new case? This guy only seems to pay when compelled, I just want him out b/c he is not good for his word.

We still have a follow up date for damages/status from the original judgement in mid June. Do we use that date to explain our mistake to the judge or open a new case?

The order of possession did not terminate your case - it is not a "judgment". Show up to your date in June, tell the court what you said here, and start the eviction proceedings.
