leasing a house
I leased a house from a builder and in the contract it states: ''On Jan 20, 2007, Tenant will Deposit $5000.00 to secure the performance of the terms and conditions of this Lease. No improvements can be made to the property or premises prior to receiving said deposit.'' That is word for word in the deposit part of the contract. I would like to know if I do not do anything to break the least. I should get my deposit back right? The builder is trying to keep it.

What are the stated reasons the builder is trying to keep the $5,000? Why do you want to get your deposit back? Have you made written demand for the return of the $5,000? This message is not legal advice because you are not as yet my client.
