Legal Question in Landlord & Tenant Law in Illinois
Leasing issues
If i am behind on my rent and the landlords wants me out of the unit. Not papers for eviction has been filed, i have not pending court date for eviction process. Howevr the landlord has entered into a rental agreement with my step-daughter to take over the unit and has given me a week to vacate the unit. My question is according to the leasing laws in the state of illinois, can my landlord lease to unit to some else who is residing in the unit already and only have me put out lake unit when not only am i still under lease and everything in the unit belongs to me and my wife and not my step daughter who is only there temporarily.

Re: Leasing issues
If your landlord wants you out of the apartment, he/she has to follow the formal eviction process. He/she needs to file an eviction complaint, serve it on you in person, have you come to court on the designated date, and have the court enter an order of possession for the unit. The lease with your step-daughter is void until you are properly and formally vacated from the unit. You might want to look up the Chicago Landlord Tenant Ordinance for more information -- it is very comprehensive and will explain all of your rights.
