Lessor did not sign lease agreement and cannot be found anywhere
Hi - I am reposting with a few more comments and facts. I am happy to share more information re: our Decs/ByLaws, however it appears I would have to email them and cannot respond via this site.
We live in a 4 unit condo building in IL. One of the units is rented, however, the lease was signed by the rental agent on behalf of the unit owner. The rental agent has no Real Estate License and has no authority to sign.
Further, the unit owner was a 'straw purchaser' and has never been seen; no mortgage payments or assessments were ever made and the unit is about to go into foreclosure.
Since they owner has not paid any assessments, they have violated a covenant in the Decs/ByLaws.
Additionally, we sent a Forcible Entry and Detainer letter 3 months ago with no response.
Since the renters are paying rent to a PO Box that we know is NOT the unit owner, can we post a 10 day eviction notice? Or would it have to be 30 or 60?
And are the renters in a legal binding agreement/lease with any rights? Or is it completely fraudulent.
