I live in a 2-flat building that has been sold to a new owner. I have 30 days to move from the property, yet the new owner has already begun to rehab the upstairs apartment and basement areas. My senior citizen mother who is suffering from cancer resides with me, and this noise/harassment is adversely affecting her health as well as our peace of mind.
Is it legal for someone to be able to rehab property while tenants are still living on the premises? Also, do they need a permit from the city to conduct the rehab?

Yes, the landlord needs a construction permit in the City of Chicago. The new landlord also assumed all the obligations under your lease imposed upon the old landlord for "quiet enjoyment" of the premises. But a court couldn't resolve your case within 30 days. You may want to ask around the neighborhood to see if there's a mediation service available to you. Also, call the Chicago Volunteer Legal Service at 312-332-1624.
The city has ordinances about noise hours and when work can be conducted. Yes permits are needed for most work (other than things like hanging wallpaper and cosmetics).
