i live in illinois and we had a flood in our apartment on jan. 1st. because of that flood we have a huge mold problem and our landlord wont do anything to fix it. i have 4 small children and he is sueing me and my fiance for damages cause by the flood. i need to know what papers to file to file a counter suit against him

Do you have a lease? Take it to an attorney for advice. You have no lease? As long as you did not cause the flooding, and the place is no longer habitable, you may be able to terminate the lease and move on without liability. Again see an attorney to make sure you handle it the right way. If you did cause the flooding, that may present different issues. Again, see an attorney who can protect you. Nobody can advise you how to file without a better understanding of the situation.
