Legal Question in Landlord & Tenant Law in Illinois
I live in a non smoking building. The property manager came out because a tenant reported smoking in the building. So she checked my unit, by only coming in the door and leaving right back out. Didn't do a complete walk through that was on May 10th. The following week I received a letter in the mail saying i violated my lease and that it grounds for termination. What does that exactly mean? Oh and I wasn't smoking, don't smoke plus I have an ill son in the home.

Any tenancy can be terminated for a variety of reasons, although there are more hoops in Chicago, Evanston, Mount Prospect and some other select communities that have local landlord-tenant ordinance. HOWEVER, under ANY of the eviction rules, a notice must SPECIFY what the claimed violation is, in order to give you an opportunity to cure if curable. So if you received a notice but no specific lease violation, it is NOT good notice. Not knowing where your apartment is, however, you should have an attorney look at the notice, because you may NOT be reading it properly and/or you may need the attorney's help regardless.
