Legal Question in Landlord & Tenant Law in Illinois
I was living with my fiance and his name is on the lease; we both got incarcerated together. I got out twenty-eight days later. While he was still in there. The landlored is holding our property and refuse to return it. How can i retrieve it without causing and further dillema? And what if somethings are missing?

If the landlord is withholding possession of the apartment for non-payment of rent it could very well be that the landlord is violating the Illinois law that requires a court-ordered eviction. Your problem is that it sounds as though you are not on the lease and the landlord in these situations is not obligated to deal with you and it sounds like your boyfriend is in no position to help. Hopefully you had a criminal law attorney deal with the incarcertaion? Ask him or her for the name of an attorney who deals with these things if he or she doesn't.
