Legal Question in Landlord & Tenant Law in Illinois

malicious eviction and future rent demand

I recently paid my rent on time (as always) by hand delivering a check in an envelope with a sixty day notice that I'd move out. My landlord refused to believe they received the check and arguments ensued. In the end they acknowledged they had found the check and that it was posted to the 'wrong appartment'. This is funny as my address is on my check.

Anyway, they refused to acknowledge the sixty day notice was ever received...a few days later I got an eviction notice claiming I was in breach of my lease because I looked after a friends dog for one night (I have one of my own, and the complex accepts pets)...now we moved out within the 10 days notice, but my landlord is demanding future rents until the end of my lease. Am I liable for future rents when it was on my landlords wishes that I left?

Re: malicious eviction and future rent demand

It all depends on your lease but it sounds like you might be in violation but again until you have an attorney review the lease you will not know for sure.
