Have to move and have a broken ankle.
I am behind on rent, but was planning on getting caught up with my next 2 checks. I had to pay the college bill for my son in order to keep him in school and am a divorced mother of 2.
I fell and broke my ankle in Dec., due to ice where I rent and had surgery. I have not been able to work since. I told the landlord about it. On Jan. 16 he came and asked me to leave and the 15th is on a Wed., so by that weekend. I apologized for being late w/rent and told him I'd catch him up, and he said, I know. I still can't walk on my ankle, and appt the 1st of Feb. and may be able to walk on it. He hasn't asked for the rent and I think his daughter needs a place to live and that's the real reason. Again, he really didn't say and I wasn't prepared and didn't ask. If I don't get moved by that date, what can I do? Considering I can't walk and am unable to drive, I'm unsure of my rights. I don't have a copy of the lease and came in May, 04. I'm not sure if it's monthly or yearly. I'm not asking him to pay any of my medical bills and don't know if I could since it was ice. Any advice?

Your landlord has to serve you a 5 day notice during which time you can catch up on your past due rent. If you fail to pay the rent during that time then he will have to file an eviction suit in court and get a court order which gives him the apartment back.
