Legal Question in Landlord & Tenant Law in Illinois
If a person has been living in your home for a few years and has not paid rent can you kick them out or do you have to evict them
1 Answer from Attorneys
There are many forms of "rent" that can include chores and other non-monetary consideration. Even just taking care of the home while you are gone could be considered part of the "bargain", tax considerations aside. But Illinois law basically says if someone has come onto your property with your permission (I assume) and you then want them off, you're supposed to follow the rules regarding notice and possibly an eviction lawsuit. I suggest you sit with an attorney and give them all the facts (which could include questions that this forum is really not well suited to deal with) and then make a determination. Even if it was a "gift" of residency, they came on board with permission....
